  • Inform us promptly of any changes to your contact information or circumstances
  • Comply with all applicable laws and regulations
  • Not use our services for any unlawful or inappropriate purposes

5. Fees and Payment

5.1 Professional Fees

Our professional fees are provided in Hong Kong Dollars (HKD) and will be communicated before beginning work. Current service fees are available on our website and may be subject to change with notice.

5.2 Government and Third-Party Fees

Government filing fees, technical specialist fees, and other third-party costs are additional to our professional fees and are your responsibility.

5.3 Payment Terms

Payment is typically required before filing applications or commencing significant work. We accept bank transfers and other payment methods as agreed. Overdue amounts may incur interest charges.

6. Intellectual Property Rights

6.1 Your Intellectual Property

You retain all rights to your trademarks, inventions, and other intellectual property. By engaging our services, you grant us permission to use this information solely for providing the contracted services.

6.2 Our Materials

All materials, documents, and advice we provide remain our intellectual property unless specifically transferred to you upon completion of services and payment of fees.

7. Confidentiality

We maintain strict confidentiality regarding client information and intellectual property details in accordance with professional legal standards. Information will only be disclosed:

  • With your explicit consent
  • To trademark and patent offices for filing purposes
  • To technical specialists assisting with your matter
  • As required by law or professional regulations

8. No Guarantees of Registration

While we provide professional services to support trademark and patent registration, we cannot guarantee successful registration. Trademark and patent offices have independent examination processes, and registration outcomes depend on numerous factors including prior rights, distinctiveness, and examiner assessment. Our services involve using reasonable professional skill and care in pursuing registration on your behalf.

9. Limitation of Liability

To the fullest extent permitted by Hong Kong law:

  • Our liability for any claim is limited to the fees paid for the specific service giving rise to the claim
  • We are not liable for indirect, consequential, or special damages
  • We are not liable for delays caused by government offices or third parties
  • Professional indemnity insurance is maintained as required by law

10. Termination

10.1 Termination by Client

You may terminate our services at any time by written notice. You remain responsible for fees incurred up to the termination date and any costs for work already performed.

10.2 Termination by Us

We may terminate services if professional ethical obligations require it, if fees remain unpaid, or if you fail to provide necessary cooperation or information.

10.3 Effect of Termination

Upon termination, we will provide copies of your matter file and take reasonable steps to protect your interests. Outstanding fees remain payable.

11. Dispute Resolution

If disputes arise regarding our services, we encourage clients to first contact us directly to discuss concerns. If resolution cannot be reached informally, disputes shall be resolved through the following process:

  • Informal negotiation between the parties
  • Mediation if negotiation is unsuccessful
  • Litigation in Hong Kong courts if mediation fails

12. Governing Law

These Terms and Conditions are governed by the laws of the Hong Kong Special Administrative Region. Any legal proceedings arising from these terms shall be brought in the courts of Hong Kong, and you consent to the jurisdiction of these courts.

13. Professional Standards

Our services are provided in accordance with professional ethical standards applicable to legal practitioners in Hong Kong. We maintain professional indemnity insurance as required by law and comply with continuing professional development requirements.
